Terms of Service

Effective date: September 4, 2026

These Terms are an agreement between you and My Goosie LLC (“My Goosie,” “we,” “us,” or “our”). They govern the Spellfort app, website, games, audio, and related services (the “Service”). By using the Service, you agree to these Terms and our Privacy Policy.

1. Eligibility

You must be at least 13 to use Spellfort. If you are under the age of legal majority where you live, you need a parent or guardian’s permission and supervision. If you use Spellfort for an organization, you confirm that you can bind it to these Terms.

2. Voice data

While Spellfort shows that it is listening, it captures spoken commands, guesses, and feedback and sends audio and transcripts to us and our providers. We may retain and review them to operate and improve Spellfort and its supporting models and automated systems. The Privacy Policy explains these practices and your choices.

The first-run Continue button confirms your voice-data consent and acceptance of these Terms. You may withdraw consent in About Spellfort, but this does not delete previously collected data. Only record people who know and agree that Spellfort is listening. Do not record private conversations or submit unnecessary sensitive information.

3. Accounts and license

Spellfort requires Sign in with Apple and may assign a device credential to save progress and secure communications. You are responsible for activity on your account and for keeping your Apple account, devices, and credentials secure. Contact us if you suspect compromise.

We grant you a personal, limited, revocable, non-transferable, non-sublicensable license to use Spellfort for non-commercial entertainment, subject to these Terms. The Service is licensed, not sold, and we and our licensors retain all other rights.

4. Acceptable use

You may not:

  • use the Service unlawfully or to harm, threaten, harass, or exploit anyone;
  • disrupt the Service, bypass controls or limits, probe for vulnerabilities, or introduce malicious code;
  • reverse engineer, scrape, copy, redistribute, sell, or create derivative works from the Service, except where law permits;
  • automate requests, extract game catalogs, or use Service content or output to train another model or build a competing product without our written permission;
  • impersonate someone or misrepresent your affiliation with My Goosie; or
  • submit infringing, malicious, illegal, abusive, or deliberately disruptive content.

5. Content, AI, and feedback

Automated speech recognition and AI help interpret input, judge answers, and create or select responses. They may misunderstand speech or produce incorrect, inconsistent, or unsuitable results. Spellfort is entertainment, not an authoritative source or medical, legal, financial, or other professional advice.

Spellfort’s software, designs, artwork, narration, characters, formats, text, databases, audio, trademarks, and other content belong to My Goosie or its licensors. Third-party content remains its owners’ property. If you send feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate it without compensation or attribution. Personal information remains governed by the Privacy Policy.

6. Purchases and subscriptions

Spellfort may offer limited free access, trials, or other promotions. Availability and limits may vary. Paid access may require a subscription or other purchase. The applicable offer, eligibility, price, billing period, and features are shown before purchase.

Apple bills subscriptions, which renew at the billing interval shown at purchase unless canceled. Apple may charge within 24 hours before the current period ends. Manage or cancel in your App Store account settings; cancellation leaves access through the paid period. Deleting your account or app does not cancel a subscription. Apple’s terms also apply to purchases and refunds. We may change future prices or offerings with notice and consent required by law and App Store rules.

7. Third parties and Service changes

Spellfort relies on third parties for distribution, authentication, speech recognition, generated audio, AI, diagnostics, hosting, and networking. Their availability and terms may affect the Service; their own terms and policies govern your use of their services.

We may change, suspend, or discontinue any part of Spellfort. We do not promise that progress, scores, content, voices, or features will always remain available. We may suspend or end access for a material violation of these Terms, risk to others or the Service, or legal or security reasons.

8. Disclaimers and liability

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without express or implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted operation.

To the fullest extent permitted by law, My Goosie and its members, employees, contractors, licensors, and providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, data, goodwill, or opportunities. Our total liability for Service-related claims will not exceed the greater of what you paid us during the 12 months before the claim arose or US $100. Some jurisdictions do not allow these disclaimers or limits; non-waivable consumer rights still apply.

9. Changes and general terms

We may update these Terms and their effective date as Spellfort changes, with additional notice when required. Continuing to use the Service after updated Terms take effect means you accept them; otherwise, stop using the Service.

If a provision is unenforceable, the rest remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our permission; we may assign them in a financing, merger, reorganization, or sale. These Terms and the Privacy Policy are the entire agreement about the Service.
